Arbitration costs / Article 20 of the ICC Rules/ Defendant to bear the total amount of arbitration costs / Calculation of fees of Claimant's counsel

'In awarding the arbitration costs, the Arbitral Tribunal shall apply Article 20 of the ICC Arbitration Rules. Defendant, having lost his case and being furthermore in default since the beginning of 1990, shall bear the total amount of the arbitration costs, including the arbitrators' fees and the administrative costs fixed by the ICC Court of Arbitration, the expenses incurred by the members of the Arbitral Tribunal, the fees and expenses of the experts and the Claimant's normal legal costs. To the extent that such costs were paid by Claimant, Defendant shall reimburse them. . . .

Regarding the Claimant's legal costs, Claimant's Counsel indicated that under the agreement with his client his fee would be the same as that of the arbitrators, thus limiting his claim. The Arbitral Tribunal feels that this basis for his fee, though perhaps an unusual one, but surely below rather than above the normal standard, can and should be allowed.'
